Terms of Service — Construction Estimator

1. Acceptance of Terms

By accessing or using Construction Estimator (“constructionestimator.co,” “the Service,” “we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to all of these Terms, you may not access or use the Service. We may update these Terms from time to time; continued use of the Service after changes constitutes acceptance of the revised Terms.

2. Description of Service

Construction Estimator is an AI-powered platform that provides construction cost estimates for home improvement projects. The Service includes online calculators, AI photo analysis, PDF report generation, and related tools. Estimates are generated using regional cost data, material pricing databases, and machine learning models.

3. Estimate Disclaimer

All cost estimates provided by the Service are approximations for informational and planning purposes only. They are not professional appraisals, bids, quotes, or guarantees of actual construction costs. Actual project costs will vary based on contractor pricing, site conditions, material availability, permit requirements, and other factors beyond our control.

You should always obtain multiple written quotes from licensed, insured contractors in your area before beginning any construction project. Construction Estimator is not a licensed contractor and does not perform construction work.

4. User Accounts

Some features of the Service require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration. You must notify us immediately of any unauthorized use of your account.

5. Subscriptions and Billing

Construction Estimator offers free and paid subscription plans. By subscribing to a paid plan, you agree to pay the applicable fees as described on our Pricing page.

Billing cycle: Paid plans are billed monthly unless otherwise specified. Your subscription will automatically renew at the end of each billing period.
Free trial: If offered, free trial periods convert to paid subscriptions at the end of the trial unless you cancel before the trial expires.
Cancellation: You may cancel your subscription at any time through your account settings or the Stripe billing portal. Cancellation takes effect at the end of the current billing period. No prorated refunds are issued for partial billing periods.
Price changes:We may change subscription prices with 30 days' notice. Continued use after a price change constitutes acceptance of the new pricing.

6. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose or in violation of any applicable laws
Attempt to reverse-engineer, decompile, or disassemble any part of the Service
Use automated scripts, bots, or scrapers to access the Service without prior written consent
Interfere with or disrupt the integrity or performance of the Service
Resell, sublicense, or redistribute the Service or its outputs without authorization
Upload malicious content, viruses, or harmful code
Misrepresent estimates generated by the Service as professional contractor bids or appraisals

7. Intellectual Property

The Service, including its design, code, algorithms, cost databases, AI models, content, and branding, is owned by Construction Estimator and is protected by copyright, trademark, and other intellectual property laws. You retain ownership of any photos or project descriptions you upload, but you grant us a limited license to process that content for the purpose of generating estimates.

8. Limitation of Liability

To the fullest extent permitted by law, Construction Estimator and its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or in connection with your use of the Service.

Our total aggregate liability to you for any claims arising from or relating to the Service shall not exceed the amount you have paid us in the twelve (12) months preceding the claim.

9. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that estimates will be accurate for your specific project.

10. Indemnification

You agree to indemnify and hold harmless Construction Estimator and its affiliates from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination shall survive, including ownership, warranty disclaimers, indemnification, and limitations of liability.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in Delaware.
